Lingo provides services that include, but are not limited to:
"Company," "we," "us," "our" refers to Lingo.
"Client," "you," "your" refers to any individual, business, or entity engaging with Lingo for services.
"Services" refers to all website design, website development, IT services, cybersecurity, network cabling, managed IT, and related work performed by Lingo.
"Project" refers to any specific scope of work agreed upon in writing between Lingo and the Client.
2. Scope of Services
Website design, development, hosting, and maintenance
Search engine optimization (SEO) and digital marketing
Managed IT services, cybersecurity, and network cabling
Consulting, troubleshooting, and technical support
The exact scope of work will be outlined in a written proposal or service agreement before work begins.
3. Client Responsibilities
To allow us to deliver quality service, you agree to:
Provide all necessary content, materials, and access credentials in a timely manner.
Ensure that all information provided is accurate and does not infringe on any copyright, trademark, or other rights.
Respond to communications promptly to prevent delays in the project timeline.
Delays in providing requested information or approvals may result in extended timelines or additional fees.
4. Fees & Payments
All fees will be outlined in your project proposal, invoice, or contract.
A deposit may be required before work begins, with the balance due according to the agreed payment schedule.
Late payments may incur a late fee and could result in suspension of services until payment is received.
All prices are exclusive of taxes unless otherwise stated.
5. Revisions & Changes
We strive to accommodate reasonable revisions within the agreed project scope.
Any additional requests outside the original scope will be billed at our current hourly or project rate.
Significant changes after final approval may require a new agreement.
6. Intellectual Property
All original content, code, graphics, and materials created by Lingo remain our property until full payment is received.
Upon full payment, ownership rights for the final deliverables (excluding third-party materials) will transfer to you.
We reserve the right to showcase completed work in our portfolio, marketing materials, and case studies.
7. Third-Party Services
If your project requires third-party software, hosting, or tools, you may be responsible for those costs.
We are not liable for downtime, errors, or issues caused by third-party providers.
8. IT Service Limitations
While we take every precaution to secure systems, protect data, and maintain uptime:
We cannot guarantee 100% protection against cyberattacks, data loss, or system failures.
The Client is responsible for maintaining appropriate backups unless a managed backup service is included in the agreement.
9. Warranties & Disclaimers
Our work is provided "as is" without warranties beyond those stated in the signed service agreement.
We are not responsible for loss of revenue, profits, or data due to service interruptions, security incidents, or system malfunctions.
10. Termination
Either party may terminate the agreement with written notice if the other party materially breaches the terms.
In the event of termination, the Client will pay for all work completed up to the termination date.
Deposits are non-refundable unless otherwise stated in writing.
11. Limitation of Liability
To the fullest extent permitted by law, Lingo’s liability is limited to the total amount paid by the Client for the services in question.
12. Governing Law
To the fullest extent permitted by law, Lingo’s These Terms & Conditions are governed by the laws of the State of Arkansas. Any disputes will be resolved in the courts located in Saline County, Arkansas.
13. SMS Communications
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Lingo Technologies. This includes SMS messages for conversations (external). Message frequency varies. Message and data rates may apply. See our privacy policy. Message HELP for help. Reply STOP to any message to opt out.
14. Updates to These Terms
We may update these Terms & Conditions at any time without prior notice. The updated version will be posted on our website with a new "Last Updated" date.
